1. Acceptance of Terms
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Consent Notice. If you do not agree with any part of these Terms, you must not access or use the Platform.
2. Description of Service
Quick Scan Breach Guard is an informational tool that allows authorised users to check whether an email address appears in publicly known data breaches, stealer logs, or public pastes indexed by the Have I Been Pwned (HIBP) service. The Platform also enables generation of a downloadable PDF summary of results.
The Platform is provided for informational and security awareness purposes only. Results reflect data made available by third-party sources at the time of the query and may not be exhaustive or current.
3. Eligibility
You must be at least 18 years of age to use the Platform. Users below 18 must obtain verifiable consent from a parent or lawful guardian as required under applicable law, including the Digital Personal Data Protection Act, 2023.
You represent and warrant that you have the legal authority to agree to these Terms and to use the Platform in compliance with applicable law.
4. Access & Authorised Use
Access to the Platform is granted by Cybervahak Consultants Private Limited through authorised access links or account credentials. You agree:
- Not to share, transfer, or disclose your access link or credentials to any unauthorised party;
- To use the Platform only for lawful purposes and only in a manner consistent with these Terms;
- To submit only email addresses that (i) belong to you, (ii) belong to someone who has authorised you to check them, or (iii) you are otherwise legally entitled to query;
- To be responsible for any activity that occurs under your credentials or access link.
5. Prohibited Conduct
You agree that you will not:
- Use the Platform to harass, stalk, dox, or otherwise harm any individual or organisation;
- Use automated means (bots, scrapers, crawlers) to access, query, or extract data from the Platform;
- Attempt to bypass rate limits, access controls, authentication, or any security feature of the Platform;
- Reverse engineer, decompile, or disassemble any part of the Platform;
- Interfere with or disrupt the integrity or performance of the Platform or its underlying infrastructure;
- Use results obtained from the Platform to perform credential stuffing, phishing, account takeover, or any other unlawful activity;
- Resell, sublicense, or commercially exploit the Platform or its output without prior written authorisation.
6. Third-Party Services
The Platform relies on third-party services - in particular, the Have I Been Pwned (HIBP) API operated by Troy Hunt - to retrieve breach, stealer log, and paste information. Email addresses you submit are transmitted to HIBP as part of this query. HIBP's privacy policy governs their handling of that data.
We do not control, and are not responsible for, the availability, accuracy, completeness, or policies of third-party services. Your use of third-party services through the Platform is at your own risk.
7. Intellectual Property
All rights, title, and interest in and to the Platform - including its software, design, trademarks, and all content we provide - are and shall remain the exclusive property of Cybervahak Consultants Private Limited and its licensors. No rights are granted to you other than the limited right to access and use the Platform in accordance with these Terms.
Breach data surfaced through the Platform is sourced from third parties and remains subject to their respective rights and licences.
8. Disclaimer of Warranties
The Platform is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.
We make no warranty that the breach-check results are complete, accurate, current, or suitable for any particular purpose. A “clean” result does not guarantee that your credentials are safe; an email flagged as breached does not, by itself, confirm current compromise. You are solely responsible for any decisions or actions you take based on information obtained through the Platform.
9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Cybervahak Consultants Private Limited, its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of, or inability to use, the Platform, even if advised of the possibility of such damages.
If you believe you have a claim arising out of or relating to these Terms or the Platform, please contact us at contact@cybervahak.com so that we may review and address the matter.
10. Indemnification
You agree to indemnify, defend, and hold harmless Cybervahak Consultants Private Limited and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (i) your access to or use of the Platform; (ii) your violation of these Terms; or (iii) your violation of any third-party right, including any intellectual property or privacy right.
11. Privacy & Data Protection
Our collection, processing, and sharing of personal data is governed by our Consent Notice, issued in accordance with the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025. By using the Platform, you acknowledge that you have reviewed the Consent Notice and consent to the data practices described therein.
You may withdraw your consent, exercise data rights, or lodge a grievance using the mechanisms described in the Consent Notice.
12. Termination
We may suspend or terminate your access to the Platform at any time, without notice, if we believe you have violated these Terms, engaged in prohibited conduct, or for any other reason at our reasonable discretion.
You may stop using the Platform at any time. Withdrawal of consent under our Consent Notice may also result in termination of your access.
Provisions of these Terms that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability, indemnification, and governing law - shall survive.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located at Mumbai, Maharashtra, India.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated through the Platform. Your continued use of the Platform after such changes become effective constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Platform.
